Terms of Service

1. Acceptance of Terms

By accessing or using the GigMatch.ai website (the “Site”) and/or the GigMatch.ai Chrome extension (the “Extension”) (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Service.

2. Description of Service

GigMatch.ai provides AI-powered tools that analyze content from publicly available freelance job posts on platforms like Upwork, generate match scores, and draft proposal content to assist freelancers in finding and winning work.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Service.

4. Subscription & Payments

The Extension is offered on a subscription basis after an optional free trial.
Payments are processed by our commerce provider Paddle. By subscribing you agree to their terms in addition to ours.
Subscriptions renew automatically unless cancelled before the next billing date.
You may cancel at any time. Access will remain until the end of the current billing period and no further charges will occur.

5. License & Permitted Use

We grant you a limited, non-exclusive, non-transferable license to install and use one copy of the Extension for your personal freelancing activities on Upwork.
You may not reverse-engineer, decompile, resell, or redistribute the Service.
You agree to comply with all applicable laws and the terms of any third-party platforms you use in conjunction with the Service.

6. User Data

Use of personal information is governed by our Privacy Policy. You are responsible for the accuracy of any data you provide to the Service.

7. Intellectual Property

The Service and all related content, trademarks, and logos are the property of GigMatch.ai or its licensors. Nothing in these Terms transfers any ownership rights.

8. Disclaimers

GigMatch.ai is not affiliated with, endorsed, or sponsored by Upwork Global Inc.
Match scores and proposal drafts are provided for informational purposes only. We do not guarantee that you will win any specific job or earn any specific amount.
The Service is provided “as is” without warranties of any kind, express or implied.

9. Limitation of Liability

To the maximum extent permitted by law, GigMatch.ai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues arising from your use of the Service.

10. Indemnification

You agree to indemnify and hold GigMatch.ai harmless from any claims arising out of your violation of these Terms or applicable law.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or suspected abuse. Sections 7–12 shall survive termination.

12. Changes to the Service or Terms

We reserve the right to modify or discontinue the Service or these Terms at any time. Material changes will be announced on the Site and/or in the Extension. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to its conflict-of-law provisions. Any litigation shall be brought in the courts located in Houston, Texas.

15. Refund Policy

Due to the nature of digital products, we do not offer refunds once a subscription has started. If you believe you were charged in error or experienced a technical issue, please contact us at hello@gigmatch.ai, and we’ll do our best to resolve the issue.
